Submitting and Resolving Copyright Disputes

Before submitting a DMCA complaint, please ensure that these products are not subject to exceptions, whether it’s fair use or similar. Such requests can only be sent by owners of protected products or their authorized representatives.

Following the DMCA law, the TemplateMonster team will remove inappropriate content from the catalog and check the accounts of authors who have received the DMCA complaint. In case the Author does not reply to the dispute in time (within 3 business days) TemplateMonster obtains the right to remove the product from sale. In case the product contains bugs the product will be removed from sale until it is fixed by the Author.

If you are a copyright owner and you believe your rights have been infringed, please submit a ticket with your DMCA complaint completing it with the following information:

  • Original works (URLs on third-party websites or product IDs in the TemplateMonster catalog).
  • A link to a product that infringes copyright.
  • Other information that will help investigate the issue.

All complaints will be considered individually, and both author and declarer will receive detailed feedback on the complaint.

To be able to resolve the complaint ASAP TemplateMonster requires complete information (both the original work and the allegedly infringing work) to verify the copyright infringement claim. Screenshots or account names alone cannot be used to investigate suspicious accounts. In order to compare the source product with the infringing one, you will need to provide us with the necessary information.

Why was my product removed?

We have received a notice from the copyright owner with evidence that your product infringes their copyright. The law obliges us to take action in such cases, so we have removed products that violate copyright.

What should one do if a product was deleted by mistake?

Counter-notifications are allowed if you believe your product has been falsely reported. If you don’t believe that your work infringes the copyrights indicated in the complaint, you must explain why. For example, you can state in your counter-notice that your work was mistakenly identified as infringing, that the copyright of the product you used has expired, or that you are protected from copyright infringement. The counter-notice must state why your product doesn’t infringe copyright. It is your responsibility to confirm (under penalty of perjury) that the information you provided is true and agree that the copyright owner may sue you if you provide incorrect information in your counter-notice.

What will happen to the commission for selling a product that infringes copyright?

The author won’t earn a commission until all the circumstances surrounding a product complaint are clarified, and if the product turns out to have been stolen, the commission for its sale will be deducted, and the product itself will be deleted.

What happens if some author receives more than one DMCA complaint?

TemplateMonster marketplace reserves the right to remove all products of such authors.
